Uninsured Motorist and Underinsured Motorist Cases

Claims Against Uninsured Drivers:

Unfortunately too many drivers who operate their vehicles fail to obtain the insurance that is required by law. These uninsured drivers pose a danger to every other driver and pedestrian on the roadway because if they make a mistake and cause a collision they have no insurance to pay for any damages or injuries caused by them.

Have you sustained a serious personal injury because of a collision that was caused by an uninsured driver? If so call us immediately. Our uninsured motorist attorneys have substantial experience in obtaining compensation for injured parties, even when the at-fault party was uninsured.

We can frequently pursue compensation for our injured clients who are involved in collisions with uninsured drivers by:

  • Accessing our client's uninsured motorist benefits through their own insurance policy
  • Establishing liability for the collision against the at-fault party's principal or employer
  • Pursuing an injury claims against those who are uninsured but have assets that can be seized or wages that can be garnished

Claims Against Drivers who are Underinsured:

In the state of Illinois drivers are only required by law to have insurance policies that provide for coverage of $20,000 per person and $40,000 per collision for injuries and $15,000 for property damage.

Many drivers choose only to obtain the minimum limits to keep their premiums down. Unfortunately if you are involved in a collision with such a driver and you sustain a serious injury you will very quickly see such policy limits exceeded by the medical bills alone. Because of this we strongly recommend to our clients that they carry a minimum coverage of $100,000 per person and $300,000 per collision and uninsured and under-insured limits that are the same level; however, if you can afford more you should get it.

When the at-fault person's insurance policy limits are not sufficient to compensate a person for their injuries we can often times turn to our client's own insurance policy to access their underinsured motorist benefits for additional compensation.

If you have been involved in a collision with a driver who was uninsured or underinsured you need to hire an experienced personal injury attorney as it is the only way to protect your interests and ensure that you receive the compensation you deserve and need.

Be aware, uninsured and underinsured motorist benefits work differently than typical personal injury cases. Because of this different statute of limitations periods, laws, and rules can apply to accessing such benefits. For this reason and many others it is in your best interest to retain a qualified personal injury attorney to assist you in accessing such benefits to ensure you obtain the necessary compensation.
